**** UNAPPROVED UNTIL NEXT MEETING**** 

Pursuant to due call and proper notice thereof, a meeting of the Breckenridge City Council was held on Monday, May 5, 2008, at 5:00 p.m., City Hall Council Chambers, Breckenridge, Minnesota. 

Members Present:  Mayor Barth; Alderman Czichotzki, Woytassek, Hennen, Lund, Krueger and Kammerer.  City Attorney Fox and Interim Clerk/Treasurer-Administrator Wilson.

Members Absent:  None.

The meeting was called to order by Mayor Barth at 5:02 p.m.

Motion by Alderman Krueger to add to the agenda 7E – Resolution hiring Brian Holt as a police officer.  Seconded by Alderman Lund and carried unanimously.

Motion by Alderman Lund to approve the agenda with the addition of 7E.  Seconded by Alderman Czichotzki and carried unanimously.

Open Discussion:

Evie Fox – Spring Cleanup.  Evie Fox requested that the Council implement Spring cleanup again.  Many people do not have the access to get rid of their junk.  The City used to have a cleanup day and since they stopped, it has been missed.  She suggested that the City could contract with Waste Management and possibly the residents who use the service can be charged a fee.   Mayor Barth indicated that the homeowners can contract with Northern Waste themselves if they like.  Also, when Breckenridge did have clean up day, they did not take garbage anyway.

Motion by Alderman Hennen to approve the Consent Agenda.  Seconded by Alderman Lund and carried unanimously.  The Consent Agenda included the following: 

A.                  Motion approving the minutes of the regular City Council meeting on April 21, 2008.

B.                 Motion to file the minutes from the Public Utility Commission meeting of April 21, 2008.

Motion by Alderman Krueger to open a hearing for public input and accept the 1st reading of Ordinance No. 465 – Extending bar/restaurant hours.  Seconded by Alderman Lund and carried unanimously.  There was considerable discussion regarding the ordinance.  Evie Fox, representing the ATOD group, informed the Council that they are against the ordinance.  They feel that extending the hours will keep people away from their families longer than normal and is not in the best interest of the City.  The emphasis seems to be on the bar staying open longer, not an eating establishment.  They also feel that in the public’s eye, it will be hard to regulate that people will just be eating during those hours. 

The Council reiterated that this is a trial period and if any who participates does break the rules, they will be blowing their opportunity and it will be taken away.  The way the wording is done in the ordinance, the Council will need to act on the ordinance by November 1, 2008, or it automatically expires.     

Alderman Woytassek wanted everyone to know that contradictory to what was said at the last Council meeting and what the newspaper reported, the Pavilion opened up as a smoke-free establishment.  Therefore, the Freedom to Breath act had nothing to do with taking any business away from them. 

Mayor Barth explained to the Council that the late Leo Wanzek, owner of Wanzek Construction, put his company on the line when they were constructing the diversion channel around Breckenridge.  In the middle of construction, the Corps of Engineers told Mr. Wanzek that they may not get paid for the rest of the project.  The money was not yet allocated to the City.  Instead of stopping the project, Mr. Wanzek made the decision to fund the rest of the project himself in the hopes of the money being allocated.  Alderman Czichotzki then offered Resolution No. 11795-33/2008, “A RESOLUTION NAMING THE FLOOD DIVERSION CHANNEL OFFICIALLY AS THE LEO WANZEK DIVERSION CHANNEL,” and moved for its adoption.  Seconded by Alderman Woytassek and carried unanimously.  Interim Clerk Wilson will write up a short narrative and check on pricing to see if possibly two signs could be put up - one along Highway 75 and one along Highway 210.

Alderman Hennen offered Resolution No. 11796-34/2008, “A RESOLUTION ALLOWING THE BILLS AND CLAIMS AGAINST THE CITY OF BRECKENRIDGE, MINNESOTA,” and moved for its adoption.  Seconded by Alderman Krueger and carried unanimously.

Motion by Alderman Lund to accept the 1st reading of Ordinance No. 466 – Fees.  Seconded by Alderman Kammerer and carried unanimously.  This ordinance pertains to adding a Seasonal On-sale license for the golf course only in the amount of $100.  Special legislation was passed to allow the club house for the Bois de Sioux Golf Course to sell alcohol on the Breckenridge side of the golf course.  In past years, the fee was prorated from a regular on-sale license making it too expensive for them to participate. 

The walking bridge by the golf course connecting Wahpeton and Breckenridge needs repairs.  The Bois de Sioux Golf Club is asking for a donation from both the City of Breckenridge and City of Wahpeton to help out with some of the costs.  Motion by Alderman Hennen to donate $350 to the Bois de Sioux Golf Club for repairs to the bridge.  Seconded by Alderman Woytassek and carried unanimously.

The City was granted a $3,500 matching grant from the Twins Community Fund.  The Cal Ripken baseball group will be doing some fundraising for the matching part and they will be in charge of the improvements. 

After reviewing many applications and interviewing several candidates, the Civil Service Commission has made their recommendation for a new police officer.  Alderman Woytassek offered Resolution No. 11797-35/2008, “A RESOLUTION APPOINTING BRIAN HOLT OF SPOKANE, WASHINGTON AS A FULL-TIME POLICE OFFICER FOR THE CITY OF BRECKENRIDGE,” and moved for its adoption.  Seconded by Alderman Hennen and carried with Alderman Czichotzki abstaining. 

 Mayor Comments:

·                     Jeff Muehler was directed to set up a time and place with Warren Niesche to plant a tree for Arbor Day.

General Comments:

·                     Alderman Woytassek informed the Council that there has been interest in pursuing the Active Living Committee, so they will be going forward in looking for grants for sidewalks and walking routes.  The County has about $250,000 that can be used towards sidewalks but only on the County-owned streets. 

·                     On May 12th, there will people meeting at City Hall parking lot and then going around the town “painting the town purple” for the Relay for Life.  They will be putting up purple ribbons up at various places around town.

·                     The Brimeyer Group can meet on Friday, May 9th at 4:00.  Springsted cannot meet until June.  The decision was to have them both come to a Council meeting in June and give a presentation on their services.

·                     A letter was presented to the Council requesting a pool pass for a benefit being held for a single person.  City Attorney Fox indicated that the City cannot use City funds to benefit a private person.

Motion by Alderman Czichotzki to adjourn at 5:59 p.m.  Seconded by Alderman Lund and carried unanimously.
